Terms of Service

The agreement

These terms are an agreement between you and [Company name], [Address], company ID (IČO) [IČO], which operates Artiphy. You accept them when you create an account. You must be at least [minimum age] years old.

How we handle personal data is described in the Privacy Policy.

Acceptable use

Don’t use Artiphy to create or share content that is illegal, sexualises minors, harasses people, infringes the rights of others, or impersonates real people without their consent, including deceptive deepfakes.

Don’t try to break, overload or get around the service, its limits or its safety checks, and don’t resell access without our written agreement.

We may block prompts, remove content, and suspend or close accounts that break these rules. The usage policies of the model providers apply as well.

Credits

Generations are paid with credits, and the cost is shown before you generate. Credits you buy or receive pool into one balance and never expire while your account is open. When your balance reaches zero, new generations pause until you top up. Credits for a generation that fails are not charged.

Purchased credits are non-refundable, except where the law gives you a right to a refund.

Your content and outputs

You keep ownership of what you upload. As between you and us, what you generate belongs to you, as far as the law allows. Purely AI-generated material may not be protected by copyright in every country.

Each model provider’s licence also applies to its outputs, and some limit commercial use, so check the provider’s terms before using an output commercially.

You give us the permission we need to store, process and display your content in order to provide the service, including on pages you choose to make public. You are responsible for having the rights to everything you upload.

Liability

Artiphy is in beta and provided “as is”. AI output can be wrong, offensive or similar to existing works, so review it before you use it.

As far as the law allows, we are not liable for indirect or consequential damage, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow to be limited, or your rights as a consumer.

Changes

We may change these terms. We will tell you about material changes by email or in the app at least 30 days before they take effect.

Governing law

These terms are governed by the law of [Jurisdiction]. Disputes go to the courts of [Jurisdiction]. If you are a consumer, this does not take away the protection of the mandatory law of your country of residence.
